Terms of Service

By downloading, installing, or using the Bamboo Chinese application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Bamboo Chinese ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

Bamboo Chinese is a Chinese language learning application that provides:

• HSK-based curriculum covering levels 1 through 6
• Interactive exercises including reading, listening, speaking, and writing practice
• Spaced repetition learning system using the Ebbinghaus forgetting curve algorithm
• Gamified learning features including coin rewards and combo multipliers
• Freemium model with optional premium membership for full content access
• Multilingual user interface supporting 10 languages

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

To access certain features of the App, you may need to create an account. By creating an account, you represent and warrant that:

• You are at least 13 years of age. Users under 13 are not permitted to create accounts or use the App without verifiable parental consent.
• You will provide accurate and complete information when creating your account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You will notify us immediately of any unauthorized use of your account

We reserve the right to terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

Bamboo Chinese offers the following purchase options:

• Monthly Pass — A one-time purchase providing 30 days of premium access. Does not auto-renew.
• Monthly Subscription — An auto-renewing subscription billed monthly. Automatically renews every 30 days unless cancelled.
• Annual Membership — An auto-renewing subscription billed annually. Automatically renews every 365 days unless cancelled.

Auto-Renewal: Auto-renewing subscriptions will automatically renew unless you cancel at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your current subscription plan.

Cancellation: You may cancel auto-renewing subscriptions at any time through your device's subscription management settings. For iOS, visit https://apps.apple.com/account/subscriptions. For Android, manage through the Google Play Store app. Cancellation takes effect at the end of the current billing period; you will retain premium access until then.

Pricing: All prices are displayed at time of purchase in your local currency. Prices may vary by region and are subject to change with 30 days' advance notice.

Free Trials: When a free trial is offered, the unused portion of the free trial period will be forfeited upon purchase of a subscription.

Refunds: All purchases are processed through Apple App Store or Google Play. Refund requests must be submitted directly through those platforms: Apple App Store at reportaproblem.apple.com; Google Play at Google Play Help.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the App or its content
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App for any illegal purpose or in violation of any applicable laws
• Use automated systems, bots, or scripts to access or interact with the App
• Attempt to gain unauthorized access to any part of the App or its servers
• Upload or transmit viruses or any other malicious code
• Interfere with or disrupt the integrity or performance of the App
• Share account credentials with others or use another user's account

The App and all its content, features, and functionality — including but not limited to text, graphics, audio files, software, and the design, selection, and arrangement thereof — are owned by Bamboo Chinese or its licensors and are protected by copyright, trademark, and other intellectual property laws.

The Bamboo Chinese name, logo, and all related marks are trademarks of Bamboo Chinese. You may not use these trademarks without our prior written consent.

Nothing in these Terms transfers any intellectual property rights to you. Your use of the App does not grant you ownership of any content or materials.

Your use of the App involves the collection and storage of certain data, including your learning progress, quiz results, and profile information. You retain ownership of any content you provide.

By using the App, you grant us a limited license to use your data to provide and improve the service, including personalizing your learning experience through our spaced repetition algorithms.

We handle your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any defects in the App will be corrected

Some jurisdictions do not allow the exclusion of certain warranties, so the above limitations may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAMBOO CHINESE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our total liability to you for all claims relating to the App exceed the amount you paid to us in the 12 months preceding the claim, or $10.00 USD if you have not made any purchases.

This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise), even if we have been advised of the possibility of such damages.

We may suspend or terminate your account and access to the App at any time, with or without cause, with or without notice, effective immediately, if we believe you have violated these Terms.

Account Deletion by You: You may delete your account at any time through the App's settings. Upon account deletion, all personal data associated with your account — including your profile, learning progress, purchase history, and support tickets — will be permanently deleted from our servers within 30 days. This action is irreversible.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimer of warranties, and limitation of liability.

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' advance notice via an in-app notification or email before the changes take effect.

Your continued use of the App after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the new Terms, you must stop using the App and may delete your account.

These Terms are governed by applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved in accordance with applicable law.

EU / EEA Users: If you are located in the European Economic Area, you have additional rights under the General Data Protection Regulation (GDPR) and applicable consumer protection laws. Nothing in these Terms limits your statutory rights as a consumer.

California Users: California residents have rights under the California Consumer Privacy Act (CCPA) regarding their personal information. See our Privacy Policy for more details.
